Terms of Service.

The short version, in plain language
You pick a plan, Monthly or Annual, and each has its own commitment spelled out below. Monthly plans begin with a 12 month term, which is what keeps the monthly rate low. Annual plans are paid up front and save you two months, with the setup fee waived for new Annual signups.
You own your content, your photos, and your domain from day one. You can buy out your full site outright, code and all, for a one time fee of six months of your plan, after the 12 month term on Monthly or after just 90 days on Annual.
There are no hidden fees. If anything below conflicts with the service agreement you signed, the signed agreement controls. This page explains that agreement in the same plain language it is written in.

Section 01
Overview and agreement
These Terms govern services from Tillwork Studio LLC, operated by Daniel Fortas, Berryville, Arkansas. Submitting an inquiry, making a payment, or using any service means you agree.
When a project starts, you also sign a separate written Client Service Agreement that sets your exact plan, price, billing frequency, and commitment. If anything in these Terms conflicts with your signed agreement, the signed agreement controls. These Terms are the plain-language explanation of that agreement.
Section 02
Services and plans
Tillwork Studio designs, builds, hosts, and maintains a custom website under the plan and billing frequency you select. Three plans, each available Monthly at standard rate or Annual paid up front, published at /plans.
Billing frequency
Annual saves two months versus monthly. New clients choosing Annual at initial signup have the setup fee waived in full. Billing frequency also changes buyout timing (see Section 04).
Setup fee
Due in full before the build begins, non refundable once build work starts. The free mockup carries no charge and no obligation. The Annual waiver applies once at initial signup only, and a Monthly client who later switches is not eligible on switching.
Custom or program pricing
Including Founders pricing, locked while the account stays continuously active, forfeited if the account lapses or is cancelled, and exempt from standard rate increases while continuously active.
Section 03
Commitment and cancellation
All timing is measured from the site go live date, the date the finished site is first published at its live address.
Monthly billing track
A 12 month initial term from go live, which makes the low monthly rate possible. After that, month to month with no further commitment. After the term, cancel by written notice to tillworkstudio@gmail.com any time, and the site and billing continue through the current billing cycle plus one additional full cycle, with no prorated partial cycle and never more than one additional full cycle. Verbal notice is not accepted.
Leaving during the initial term
An early termination fee applies equal to the monthly rate times the lesser of the whole months remaining or four months. This is the full extent owed. On payment of the fee and any balance the agreement ends and the site comes down. No files, source code, or project access transfer under an early termination.
Annual billing track
The annual fee is due in full before the build, setup waived for new Annual signups. Not refundable for unused months. No early termination fee because the full term is prepaid. End any time by written notice to tillworkstudio@gmail.com with no further fee. The site stays live through the paid period unless earlier takedown is requested in writing.
Renewal and switching
At the end of the annual term it continues month to month at the then current standard monthly rate, no automatic new annual term. To keep Annual, notify in writing before renewal. A Monthly client may switch to Annual any time by written notice with the new term starting from the switch date. The setup waiver does not apply to a later switch.
Non payment
Stopping payment without notice is treated as cancellation. Within the initial Monthly term the early termination fee and any balance apply. The site may be suspended after 10 days past due and the agreement ended after 30 days past due.
Section 04
Ownership and site buyout
Your content is yours
From signing you own all photos, logos, copy, brand materials, and your domain, held in your own account at all times.
Code and assets
You own the finished code and design assets and may request an export any time while active and in good standing. What stays with Tillwork Studio is the editable project on the website platform until a buyout.
Site buyout
The one time fee is six months of your monthly rate. Monthly clients may buy out after the 12 month term. Annual clients may buy out after 90 days from go live, because payment risk is already resolved.

On payment, the complete editable project transfers to an account you control on an easy to manage platform, with all source code and files, no restrictions, no separate negotiation.
After a buyout
You cover the platform subscription directly, typically $25 to $50 per month billed by the platform not by Tillwork Studio. Hosting and maintenance end at transfer unless you choose Managed Care (Section 05). Delivering the transferred project and files is where the obligation ends.
Section 05
Managed Care, optional and post buyout
Available only after a completed buyout.
- Price $59 per month
- Includes domain renewal, SSL and security monitoring, basic SEO upkeep, and one content update per month
- Terms billed monthly, no minimum term, cancel any time with 15 days written notice
Not offered during an active Monthly or Annual plan since hosting and maintenance are already included.
Section 06
Billing
Monthly track: setup fee up front before the build, then monthly billing begins on go live or 30 days after the setup fee is paid, whichever comes first.
Annual track: setup fee and full annual fee both up front before the build.
Payment is due the same calendar date each period. Methods are bank transfer, credit card, or others agreed in writing. Existing clients get 30 days written notice before any pricing or terms change.
Section 07
Hosting
Managed on your behalf as part of the plan. You do not set up or manage hosting. On buyout, hosting transfers to you with the project unless you choose Managed Care.
Section 08
Responsibilities
Tillwork Studio will
- Build and launch within the agreed timeline
- Maintain hosting and keep the site live
- Make reasonable updates covered by your plan
- Respond to support within 2 business days
- Give at least 30 days notice before any pricing or terms change
You will
- Provide accurate information, photos, and content
- Review drafts and give feedback within 7 business days
- Keep payment information current
- Make sure provided materials are owned or licensed and cover Tillwork Studio against claims from materials you provide
- Not use the site for any illegal purpose
- Not access, modify, or reverse engineer the underlying code without written permission
Section 09
The free mockup
Remains Tillwork Studio property until a plan begins and the setup fee is paid, or on Annual until the annual fee is paid. No charge and no obligation. May not be reproduced or used as the basis for a build by any other party.
Section 10
Portfolio and the "Powered by Tillwork Studio" credit
Portfolio
Completed sites may appear in portfolio and marketing. Opt out in writing at the time you start.
Footer credit
A small "Powered by Tillwork Studio" credit and link in the footer by default, removable any time on written request, no charge either way.
Founders Program promotion
Founders clients agree to mutual promotion in exchange for their rate, meaning a case study feature on Tillwork Studio's site and a prominent credit and link on theirs beyond the standard footer credit, with specifics agreed in writing.
Section 11
Referral program
Referral rewards, credits, and any Founders eligibility earned through a referral are offered at Tillwork Studio's discretion and may change with 30 days written notice. Earned credits are honored under the terms in effect when earned. Referred clients must be new and not already in an active sales conversation. Bad-faith referrals may be disqualified.
Section 12
Limitations and liability
Services are provided as is. No guarantee of specific search rankings, traffic, or revenue. Results vary with factors outside Tillwork Studio's control.
Total liability is capped at fees paid in the 3 months before the event giving rise to a claim. Tillwork Studio is not liable for indirect, incidental, special, or consequential damages including lost revenue, lost data, or reputational harm. Tillwork Studio is not responsible for third party platform outages. Any claim must be brought within one year or is permanently barred.
Section 13
Disputes and governing law
Contact tillworkstudio@gmail.com to resolve directly before formal action. Governed by Arkansas law. Disputes handled in Carroll County, Arkansas courts. Both parties consent to that jurisdiction.
Section 14
Changes to these terms
Material changes are communicated at least 30 days before taking effect. Continued use is acceptance. The current version is always at /terms.
